Terms and Conditions
1. Who we are, and who you are dealing with
This service is run by Gorcian ("we", "us"), a provider of software for recording training, competitions, results and learning in sport. You can reach us at admin@gorcian.com.
We are not a federation, a club, an organiser or a governing body, and we do not represent, and are not affiliated with, any federation, club or country. We provide the tools. The rules of each sport are set by others.
2. What the service is
The service consists of:
- private training logs;
- competition management and recording of results under the rules an organiser chooses;
- a public site where published results and rankings can be read;
- learning and certification; and
- services offered by third parties through the platform.
The basic service is free at present. Fees for an event or for a third party's service are set by that organiser or provider and shown to you before you are asked to pay. If we ever start charging for the basic service, we will state the price and what it covers first.
3. What the service is not
We are not a judge, a body that recognises events, or the official keeper of a result. The official record of a competition is the organiser's decision and the result document they sign, not what appears on our screens.
4. Who is responsible for what
- You: the accuracy of your profile and of your training entries.
- Organisers: the data of their events, entries and registrations.
- Judges and officials: the scores, times and penalties they enter.
- Organisations that recognise an event: the membership data they manage.
- Us: running and securing the software.
5. Scores and official decisions
The service records decisions; it does not make them. Calculations follow the rules the organiser chose for the event. Objections and disputes about a result are settled under the rules of that event, its discipline and its organiser, not by us.
6. Availability, and the paper that does not depend on us
We work to keep the service available but do not promise it will never be interrupted. A competition must not depend on it: paper records remain the fallback, and competitions existed long before this service.
7. Personal data
- Who controls it. We control the data of your account and profile. The organiser of an event you enter controls that event's own data.
- The law. Personal data protection law of the Republic of Indonesia and, where it applies to you, other data protection law such as the GDPR.
- What we hold. Account: name, email address, password (stored only as a hash), country, language. Profile, if you fill it in: date of birth, gender, clubs, sports, telephone number, address, emergency contact. Your training entries; your entries and results in competitions; security activity records.
- What we use it for. Running your account, recording entries and results, security, and messages about the service. We do not sell personal data.
- What is public. Your name, country, club and the results an organiser has published appear on the public results and ranking pages. Your training entries, telephone number, address and emergency contact are not public.
- Who else sees it. Platform administrators, to manage accounts; and the organisers and officials of events you enter, as far as they need.
- Other providers and other countries. We use hosting and email delivery providers. News text, including drafts, may be sent to a third-party automatic translation service. Data may be processed outside your country.
- How long. While your account is open. When it is closed we delete or anonymise your personal data. A result already published may stay on record under the athlete's name because it is part of the record of the competition; you may ask us to limit this as far as the law allows.
- Your rights. To see your data, correct it, have it deleted, withdraw consent and object to its use. Write to admin@gorcian.com; we answer within a reasonable time and as the law requires.
- If something goes wrong. If personal data is breached we tell the people affected and the authorities within the time the law sets (for example 72 hours where that rule applies).
8. Children
A person under 18 may register only with the knowledge and consent of a parent or guardian. An organiser is responsible for obtaining the consent needed to enter a child in its event and to publish a child's photograph or result. A parent or guardian may ask us to delete a child's account.
9. Your account, and how you may use it
Keep your password to yourself and give accurate information. You must not:
- try to reach another person's account or data without permission;
- enter false results, scores or details;
- harass, threaten or impersonate anybody;
- extract data in bulk without our written permission; or
- disrupt the service.
10. Content, and ours
You keep your rights in the data and content you enter. You allow us to store, process and display it as far as needed to run the service. The software, its design, text, documentation and the Gorcian marks belong to us.
11. Our responsibility, and its limits
We undertake to take reasonable care, to secure the data we hold, and to handle it as this document says. We do not promise uninterrupted service or that data entered by others is correct.
As far as the law allows, we are not liable for indirect loss or for decisions made by organisers, and our liability is limited to the amount you paid us for the service in the last 12 months; for a free service it is limited to what the law requires. Nothing here excludes liability that the law does not allow to be excluded.
12. Suspending or closing an account
You may close your account at any time by writing to us. We may suspend or close an account that breaks these terms or the law, or where the law requires it, and will give the reason where we can.
13. Changes
We may change the service and these terms. Each version is numbered and dated, and we announce important changes. If you do not agree to a new version, close your account; continuing to use the service after a change means you accept the new version.
14. Disputes
Sporting disputes are settled under the rules of the event and its organiser. Any other dispute: write to us first. If it is not settled within 60 days, the competent courts of the Republic of Indonesia decide it, under Indonesian law.
15. Language
These terms are published in Indonesian, English, Chinese and Arabic. If they differ, the English text governs, except where local law requires otherwise.
16. Contact
Questions, requests about your data, or a complaint: admin@gorcian.com.
